Waiver
DEFINITIONS
In this Agreement, "Club Owner" means Ignite30. "Club" means the club at which the Agreement is signed. "I" and "member" mean the person whose name and signature appears on this document. The member is responsible for updating address and contact information.
CHANGES TO TERMS
Ignite30 may vary these Terms & Conditions from time to time. Members will be notified in writing of any changes, which will take effect from the notified date.
MEMBER OBLIGATIONS
This Agreement is legally binding. If I have a Minimum Term membership, my membership will automatically continue on a month-to-month basis once the Minimum Term ends unless I provide written notice to cancel.
As a member of Ignite30, I agree to:

Provide a minimum of five (5) days' written notice for any account changes, including holds, cancellations, or updates to billing.

Not conduct or participate in any commercial, coaching, or personal training activities within the Club unless I have written permission from Ignite30 management.

Keep my contact and billing details up to date and notify Ignite30 immediately of any changes.

Understand that Ignite30 operates as a single-location facility and does not offer reciprocal access, transfers, or shared use with any other gyms, fitness centres, or franchises.
MEMBERSHIP PLANS AND TERMS

Home Club: Membership applies only to Ignite30 Ellenbrook.

Minimum Term: 30 days for month-to-month. 6, 12 or 18 months for fixed-term plans.

Ongoing Agreement: Continues until cancelled with written notice. Fees continue to be debited by Ezidebit unless the agreement is properly terminated.

Casual Packages / Challenges / Promo Packs: Upfront payment required. All packages are non-refundable. Where a package, challenge, or promotional offer has set dates, these are fixed and cannot be altered, extended, or transferred.
COOLING OFF PERIOD
If I wish to cancel this Agreement, I may do so by delivering or emailing a written notice to the Club within 7 days of signing this Agreement. Refunds minus pro-rata usage and admin fee.
CANCELLATION POLICY
After the cooling-off period, cancellations require:

Written notice

30-day notice period.

25% of the remaining term to be paid as cancellation fee if cancelling during Minimum Term.
OTHER CANCELLATION CASES
-
Club Breach: Cancellation without penalty (with written request).
-
Medical Grounds: Requires documentation. Charges pro-rata for services used.
-
Club Termination: If due to member breach, all unpaid fees, cancellation, and service costs apply.
MINIMUM AGE
Members must be 16+. Under 18s require parental co-signature.
FEE INCREASES
General: Fees may increase with 30 days' notice. Ezidebit debits will reflect updated amounts.
BUSINESS CHANGES
If ownership changes, members will be notified by email. Payment arrangements will continue.
MEMBERSHIP PAUSE (FREEZE)
Eligibility:
Membership pauses are permitted under the following circumstances:

1. Medical Grounds; including injury, illness, surgery, or medical other conditions. A medical certificate or written documentation from a health professional may be requested.

2. Work or Personal Travel (Holidays); Members may pause their membership for work-related travel or personal holidays. Written proof is required (e.g., employer letter or travel booking confirmation).
Duration:
-
Limited to a maximum of 2 weeks (collectively) per year for work/ holiday commitments.
-
Pauses must be taken in blocks at a minimum of 3 days.
-
Medical pause maximum 3 months per calendar year with medical certificate or letter from allied health professional.
Notice Requirements:

Written notice must be provided a minimum 48 hours (exception made regarding medical pauses - subject to circumstance) before the requested pause start date.
-
Supporting documentation is required for work/holiday pauses.
-
Supporting documents may be requested for medical pauses if longer than two weeks.
Fees:
-
Fees are calculated pro rata for all pauses.
-
In cases where a medical pause may need to be backdated (with supporting medical documents) the account will go in to credit towards your next payment once pause ends.
Effect on Minimum Term:

Any pause period will extend the Minimum Term of the membership by the length of the freeze.

Memberships cannot be cancelled while on pause, except where cancellation is medically necessary and supported by documentation.
Exclusions:

Pauses will not be approved for:
-
General lack of use.
-
Changes in personal routine.
-
Preference outside the categories listed in this policy.
FACILITIES & MAINTENANCE
Club may close up to two weeks/year. Equipment may change at any time.
DEBT RECOVERY
Members are liable for recovery costs if non-payment leads to debt collection.
LIMITATION OF LIABILITY
Under Australian Consumer Law, Ignite30 is required to provide services with due care and skill, ensure they are fit for their intended purpose, and deliver them within a reasonable timeframe.
Because Ignite30 provides recreational services, members acknowledge and accept that participation in exercise carries an inherent risk of injury. Ignite30 is not liable for any injury or death that may occur while using the Club's facilities or services, except where such injury or death is caused by reckless conduct on the part of Ignite30, its staff, or contractors.
CLUB ACCESS & SAFETY
Members must:

Use access fobs (non-transferable)

Report lost fobs (replacement fees may apply)

Not share access or enter without their fob

Participate in mandatory one on one induction
GENERAL USAGE

Guests may attend only during staffed hours with approval.

Last workout to start 45 minutes before closing time.

Members are liable for damage they or their guests cause.
-
Personal items are the responsibility of the member. Ignite30 is not liable for loss or theft.
-
Children not permitted on the gym floor — allocated children sitting area available.
MEMBER BEHAVIOUR, HYGIENE & DRESS CODE

To maintain a safe, respectful, and welcoming training environment, all members agree to:

Maintain personal hygiene including wearing clean clothing and using deodorant.
-
Wipe down equipment after use with provided spray sanitiser.
-
Wear appropriate activewear and enclosed athletic shoes (no jeans, sandals, or inappropriate attire).
-
Refrain from aggressive, abusive, or discriminatory language or behaviour.
-
Respect the space and safety of fellow members and staff.
-
Failure to comply may result in warnings, temporary suspension, or termination of membership (may incur fees).
VIDEO MONITORING
Surveillance is in place. Members may not take unauthorised photos or videos. Trainers may take video/photo for social media purposes.
DRUG POLICY
Zero tolerance for drug use. Violations result in immediate termination.
PRIVACY POLICY
Personal information is collected and handled per the Privacy Act 1988 (Cth). Data may be used to:

Manage memberships

Provide customer service and communications

Conduct marketing (members may opt out)

Data is stored securely and will not be shared without consent unless legally required.
PAYMENT AUTHORISATION – VIA EZIDEBIT
Ezidebit is the authorised payment processor. By agreeing, members allow:

Direct debits from nominated accounts.

Payments are deducted fortnightly. Monthly or weekly payments can be arranged in club.
-
Missed payment will incur a $10 dishonour fee. This is a fee set by Ezidebit.

Adjustments in line with fee changes

Replacement of payment method if accounts are dishonoured three times
