Waiver
FITNESS PRODUCTS AND SERVICES STATEMENT
Having a membership at Ignite30 allows you access to a group fitness experience based on functional circuit training. Ignite30 is a boutique gym and does not operate on a 24/7 basis. During operating hours, members follow structured circuits under the guidance of trainers. New workouts are delivered daily to ensure variety and progression.
DEFINITIONS
In this Agreement, “Club Owner” means Ignite30. “Club” means the club at which the Agreement is signed. “I” and “member” mean the person whose name and signature appears on this document. The member is responsible for updating address and contact information.
MEMBER'S RIGHT TO CANCEL - COOLING OFF PERIOD
If I wish to cancel this Agreement, I may do so by delivering or emailing a written notice to the Club within 7 days of signing this Agreement (or from the Club's opening date if not yet open). The Club will return any payments made, less fees for services provided and an administration charge, within 10 days. Refunds are by credit or bank transfer only.
MEMBER OBLIGATIONS
This Agreement is legally binding. If I have a Minimum Term membership, I become a month-to-month member after the term ends unless I cancel. I must:

Provide five days' notice for account changes.

Not engage in commercial activity or personal training within the Club.

Update contact details as needed.
Ignite30 is not a reciprocal gym.
MEMBERSHIP PLANS AND TERMS

Home Club: Membership applies only to Ignite30 Ellenbrook.
-
Minimum Term: 30 days for month-to-month. 6, 12 or 18 months for fixed-term plans.

Ongoing Agreement: Continues until cancelled with written notice. Fees continue to be debited by Ezidebit unless the agreement is properly terminated.

Pre-Paid Memberships: Require ID and payment method. Early cancellations incur a 25% pro-rata fee. Refunds are by credit or bank transfer.

Casual packages: upfront payment required and all packages are noo-refundable.
CANCELLATION POLICY
After the cooling-off period, cancellations may be made:

Without penalty if the Club fails to deliver, in case of medical incapacity (with proof), or due to legislative rights.

With a 25% cancellation fee if relocating or cancelling for personal reasons during Minimum Term.

With a 30-day notice period.
OTHER CANCELLATION CASES

Club Breach: Cancellation without penalty (with written request).

Medical Grounds: Requires documentation. Charges pro-rata for services used.

Club Termination: If due to member breach, all unpaid fees, cancellation, and service costs apply. If the Club cancels without cause, only fees for time used apply and $50 plus joining fee is refunded.
MINIMUM AGE
Members must be 16+. Under 18s require parental co-signature.
FEE INCREASES

General: Fees may increase with 14 days' notice. Ezidebit debits will reflect updated amounts.
BUSINESS CHANGES
If ownership changes, members will be notified by email or at reception. Payment arrangements will continue.
MEMBERSHIP PAUSE (FREEZE)
Members may pause for up to 3 months/year in 2-week blocks with 5 days' written notice. A freeze extends Minimum Term. No cancellation during a freeze unless medically necessary.
FACILITIES & MAINTENANCE
Club may close up to two weeks/year for maintenance. Equipment may change at any time.
DEBT RECOVERY
Members are liable for recovery costs if non-payment leads to debt collection.
LIMITATION OF LIABILITY
Under ACL, services must be delivered with care, fit for purpose, and timely. However, Ignite30 excludes liability for injury or death resulting from recreational services, except in cases of reckless conduct.
CLUB ACCESS & SAFETY
Members must:

Use access fobs (non-transferable)

Report lost fobs (replacement fees apply)

Not share access or enter without their fob

Participate in mandatory induction
GENERAL USAGE

Guests may attend only during staffed hours with approval.

Members are liable for damage they or their guests cause.

Personal items are the responsibility of the member. Ignite30 is not liable for loss or theft.

Children not permitted on the gym floor - crèche area available
MEMBER BEHAVIOUR, HYGIENE & DRESS CODE
To maintain a safe, respectful, and welcoming training environment, all members agree to:

Maintain personal hygiene including wearing clean clothing and using deodorant

Wipe down equipment after use with provided sanitiser
-
Wear appropriate activewear and enclosed athletic shoes (no jeans, sandals, or inappropriate attire)
-
Refrain from aggressive, abusive, or discriminatory language or behaviour
-
Respect the space and safety of fellow members and staff
Failure to comply may result in warnings, temporary suspension, or termination of membership (may incur fees).
VIDEO MONITORING
Surveillance is in place. Members may not take unauthorised photos or videos. Trainers may take video/photo for social media purposes.
DRUG POLICY
Zero tolerance for drug use. Violations result in immediate termination.
PRIVACY POLICY
Personal information is collected and handled per the Privacy Act 1988 (Cth). Data may be used to:

Manage memberships

Provide customer service and communications

Conduct marketing (members may opt out)
Data is stored securely and will not be shared without consent unless legally required.
PAYMENT AUTHORISATION – VIA EZIDEBIT
Ezidebit is the authorised payment processor. By agreeing, members allow:

Direct debits from nominated accounts

Adjustments in line with fee changes
-
Replacement of payment method if accounts are dishonoured three times
IGNITE30 ASSUMPTION OF RISK, WAIVER AND MEDICAL INFORMATION
ASSUMPTION OF RISK OF INJURY AND WAIVER OF CLAIMS
I acknowledge that Ignite30 locations are supervised fitness centres and there is possible danger connected with any physical activity, including the dangers of physical injury and death. I assume all risks of injury and waive all rights to pursue money damages or any other relief of any kind arising out of:

My entry into or upon any Ignite30 location; or
-
My use of any equipment, machinery, or facilities in any Ignite30 location or Ignite30-sponsored event.
On behalf of myself and my successors and assigns, I agree to indemnify and will hold harmless Ignite30, its employees, agents, successors, and assigns from and against any loss or damage that may be sustained by me or any person entering the Ignite30 Club as my guest.
MINOR MEMBERS (IF APPLICABLE) – PARENT/GUARDIAN AGREEMENT
In exchange for the Club allowing my minor child to use the Club, I agree to the above Assumption of Risk and Waiver of Claims on their behalf. I also agree to defend and indemnify Ignite30 and its officers and employees to the fullest extent permitted by law for any claim brought by my minor child. I agree to be financially responsible for any obligations incurred by my child and acknowledge that the account listed in this Agreement is mine. I understand that any child under the age of 16 must be accompanied by an adult at all times while in an Ignite30 Club.
PHYSICAL CONDITION AND NO MEDICAL ADVICE
I confirm that I am in good physical condition and have no medical reason or impairment, other than what I have disclosed in this form, that would prevent me from participating in fitness activities at Ignite30. I understand and acknowledge that Ignite30 will not and cannot provide me with any medical advice. If I have any health or medical concerns now or in the future, I will consult my doctor before using the facilities.
DISCLOSURE OF PHYSICAL CONDITION
The provision of a safe and effective exercise program is dependent upon accurate health and fitness profiling. I agree to disclose to Ignite30 all relevant personal health and fitness information both prior to and during my participation in any program or service the Club provides. This includes results from health risk assessments, fitness evaluations, and any recommendations given by my healthcare professionals. I further warrant that I will not use Ignite30 facilities while suffering from any contagious illness, open cuts or sores, or any condition that could pose a health risk to others.
MEDICAL INFORMATION – SELF ASSESSMENT
Please consider the following:

Has your doctor ever told you that you have a heart condition or have you ever had a stroke?

Do you experience unexplained chest pain at rest or during activity?
-
Do you ever feel faint, dizzy, or lose balance during physical activity?
-
Have you had an asthma attack requiring immediate medical attention in the last 12 months?

If you have diabetes (type 1 or 2), have you had trouble controlling your blood sugar in the last 3 months?
If you answered “yes” to any of the above (excluding Q3), you must seek medical clearance before beginning an exercise program at Ignite30.
If you have any other condition or concern that may require modifications to your exercise program, you must disclose this to staff. You may be asked to provide medical clearance depending on your circumstances.
